Every year again – the statute of limitations threatens

Towards the end of the year, it is time again to look through the old, dusty documents and check your invoices for possible statutes of limitations.

Regular limitation period after 3 years

As is well known, claims generally expire after 3 years, starting with the year in which the claim arose. Exceptions are claims arising from forwarding contracts, claims for compensation by the landlord due to changes or deterioration of the rental property, and warranty rights arising from the purchase contract, which are each subject to a shorter period.

The most future-oriented option is to assert your claim in court and then issue a title, so that the limitation period of 30 years now applies. A clever alternative is to persuade the debtor to pay the bill in installments, thereby delaying the limitation period by a further 3 years. Even a small installment is sufficient for this trick, although it is advisable to confirm receipt of payment in writing if payment is made in cash. If legal proceedings arise, you are on the safe side and can forestall a possible limitation objection from the debtor.
