With MB Inkasso against refusal to pay in equestrian sports

MB Inkasso is on the road again and this time Sunday is not holy either!

A renowned riding stable with several horses and a long-standing equestrian sport has been trying to avoid paying for bedding for around 8 months. 2 semi-trailers with wood shavings were delivered to the riding stable in October last year and had not been paid for by the stable until last week, despite reminders and numerous calls from the client! The creditor of the debt was not going to put up with this any longer and called in MB Inkasso. Over €8,500 in debt was outstanding.

Complex situation and our approach

The main problem was that the rider, who was well-known in the equestrian industry, had ordered the goods but had already made the affidavit several times. At all tournaments he boasted about his successes and great horses, but behind the scenes he used his 17-year-old daughter as the owner of the stables and the horses. Years ago he also did this with his wife, from whom he has since separated, and who is still in debt to the tune of €270,000.

MB Inkasso immediately began to pursue the debtor and wrote to him directly by registered mail. Since the debtor did not respond and numerous calls did not result in payment, a team from MB Inkasso visited the debtor in person. After the debtor was found on the property, heated discussions quickly ensued.

The result was that the debtor banned us from the property in the name of his daughter and later submitted this in writing. He also made it clear to us that he could not pay anything because he had been making a sworn declaration for years.

Now the ball finally started rolling. Immediately after our visit to the debtor, the creditor of the claim filed a criminal complaint against the debtor on the advice of MB Inkasso for fraudulent entry because the debtor knowingly ordered goods for which he had to pay, although he was not able to pay at the time. The lawyers of MB Inkasso then initiated a lawsuit against the riding stable on the grounds that this was "everyday business according to Section 105". Proof of this was also the letter from the debtor with the ban on entry to the premises!

Successful attachment in case of non-payment despite judgment

After 4 months, a judgment was successfully obtained. However, since the debtor still did not pay despite the judgment, MB Inkasso took action again. At the 2023 Whitsun tournament in Wiesbaden Biebrich, the company MB Inkasso & Investigation GmbH applied for the seizure of 2 registered horses from the riding stable.

MB Inkasso arrived at the tournament with a horse transporter and a temporary injunction, as well as the bailiff, and had both of the stable's horses seized immediately before the start. The debtor was visibly upset, as many of his acquaintances from the equestrian scene had seen the seizure on site.

Successful intervention and payment

While MB Inkasso was loading the horses, the debtor's daughter approached us and arranged a quick transfer of almost €11,500, which covered and paid the entire debt and legal costs.

It was a shame that the rider, the father and actual debtor, didn't have the nerve to lead the horses successfully through the course. Yes, sometimes things don't turn out the way you think!
