However, the father was never prepared to meet these maintenance obligations. Although the father was a very successful self-employed tiler, the former secretary and current partner was the one who ran the business. As a result, the tiling company only paid out wages that could not be seized to the debtor. Nevertheless, our client was annoyed because she kept running into the biological father in town, where he was often out and about in his new car (Porsche Cayenne) and had just bought a new Harley Davidson.
However, after a further enforcement measure, our client was informed that the vehicles belonged to the tile company.
However, after about two months of research, we were able to determine that the use of these vehicles, which were certainly not intended exclusively for the tile operation and commercial use, had not been taken into account in the debtor's payroll.
Based on our investigations and findings, we visited the debtor in person on a Saturday morning and confronted him with our investigations. We also informed him that a recalculation would of course be possible at any time.
The maintenance costs incurred to date amount to approximately €16,800. After the discussion was held not only with him, but also in the presence of his life partner, it was agreed that our client would waive further maintenance claims for their son if a one-off payment of €25,000.
About a week later, this amount was transferred to our client's account. We were able to successfully enforce the maintenance claims and at the same time find an amicable solution for both parties in order to avoid further disputes.
